Learned counsel for the alleged contemnors submits that 10% p.a. interest has since been provided to the petitioners on account of delayed payment of gratuity.

Reference is made to a judgment dated May 3, 2024 passed by the Hon'ble Division Bench of this Court in FMA No.320 of 2024 with CAN No.1 of 2024 (Bhatpara Municipality -vs- Amiya Kumar Roy & Ors.) where the Division Bench was pleased to award interest @ 10% p.a. on the delayed payment of gratuity.

As it appears that in similar matters the Division Bench directed the authority to pay 10% p.a. interest, and as the municipality has already paid 10% p.a. interest in favour of the petitioner, accordingly, this court is not inclined to proceed further with the contempt application.

The contempt application is thus disposed of. 5.
