The petitioner is an elected member of Goti Gram Panchayat, Uttar Dinajpur. The petitioner is aggrieved by the wrongful deletion of some of the names of eligible persons residing in the said gram panchayat from the list of beneficiaries of the Prime Minister Awaas Yojana-G, Banglar Awaas Yojana (hereafter referred to as the said scheme).

Reliance has been placed on some communication from the alleged data entry operator to the concerned Block Development Officer, inter alia, stating that some of the names of the residents in the locality who were otherwise eligible for the benefit of the said scheme had been left out by mistake.

Mr. A.P. Lahiri, learned advocate for the State respondents submits that the writ petition is not

maintainable at the instance of the elected member of the said gram panchayat as he has no locus standi. Such contention is accepted.

The writ petition is disposed of without any order. However, if the persons whose names have been deleted are aggrieved by such deletion and if it is their specific grievance that they are otherwise eligible but left out by mistake, they shall be at liberty to approach the Block Development Officer, Goalpokher-I Development Block, by filing fresh representations which shall be considered in accordance with law within 6 weeks from receipt of the representation. A reasoned order shall be communicated. Such persons shall be heard.

This writ petition is, thus, disposed of. There will be, however, no order as to costs.

All parties are directed to act on the basis of the server copy of this order.
