Mr. Pradyot Kumar Nandi Ms. Durga Chowdhury Ms. Subhra De ... for the petitioners This application under Article of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Junior Division), 3rd Court at Purba Bardhaman to dispose of the Miscellaneous Case No. 30 of 2024 expeditiously.
The learned advocate appearing for the petitioners submits that the miscellaneous case was filed for setting aside abatement which is pending from the year 2024. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties.
However, the learned advocate appearing for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge. From the ordersheets appended to this application this Court finds that 30th July, 2025 has been fixed for hearing of the injunction application.
In view thereof, C.O. 2229 of 2025 stands disposed of by requesting the learned Civil Judge (Junior Division), 3rd Court at Purba Bardhaman to make an endeavour to dispose of the injunction application as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the injunction application the learned Civil Judge is requested to make an endeavour to dispose of Misc. Case No. 30 of 2024 expeditiously. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
