The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such prior service of notice of the present application upon the said opposite parties is dispensed with.

The petitioner is complaining inordinate delay in disposal of an appeal under Section 218 (3) of the West Bengal Municipal Act, 1993 registered as Other Suit No. 1 of 2019 pending before the 3rd Court of learned Civil Judge, (Junior Division), at Baruipur, District - 24 Parganas (South).

The opposite party nos. 1 and 2 aggrieved by the decision of the Board of Councillors of Joynagar Majilpur Municipality directing demolition of some unauthorized constructions have preferred the connected appeal on September 11, 2019.

The scope of the said appeal being very narrow, the Court of Appeal below is requested to dispose of the said appeal as expeditiously as possible, preferably

within a period of three months from the date of communication of this order without granting any unnecessary adjournment to either of the parties. C.O. 1632 of 2021 is disposed of in the above terms without any order as to costs.

The petitioner shall serve a copy of the application along with the copy of this order upon the opposite parties in course of this week.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
