The petitioner is the mother of a deceased married female primary school teacher. The petitioner has been recorded as the nominee in the Death-cumRetirement Benefit document of the deceased teacher. The teacher died-in-harness on 26.09.2023.

A representation has been made by the petitioner before the District Inspector of Schools (P.E), Hooghly on 31st January, 2024 praying for disbursal of the terminal of her deceased daughter. The same is pending consideration.

As the petitioner's prayer is pending consideration for grant of the death-cum-terminal benefit of the deceased teacher, accordingly, the instant writ petition is disposed of by directing the District Inspector of Schools (P.E), Hooghly to take steps for

consideration of the prayer of the petitioner in accordance with law, upon giving a reasonable opportunity of hearing to all other heirs and legal representatives of the deceased teacher at the earliest but positively within a period of eight weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the parties. All consequential steps for release of the terminal dues shall be taken in accordance with law.

Learned advocate appearing for the petitioner is directed to forward a copy of the representation dated 30th January, 2024 received in the office of the respondent authority on 31st January, 2024 along with all other supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
