The petitioner is admittedly holding a civil post under the Union of India.
In view of the provisions of Section 14(1)(a) read with the provisions of Sections 28 and 3(q) of the Administrative Tribunals Act, 1985, this Court lacks the jurisdiction to receive, try and determine the writ petition.
Faced with this situation, the petitioner intends to withdraw this writ petition with liberty to file afresh.
The writ petition is dismissed as withdrawn with liberty to file afresh on the self-same cause before the appropriate forum, if otherwise eligible in law. The time spent between 3rd June, 2024, being the date of filing of the writ petition and today (14.08.2024) shall be construed to have been
proceeded in a bona fide manner in prosecuting a case before a court without jurisdiction.
