This is an application for a direction for expeditious disposal of NDPS Case No.112 of 2021 pending before the learned Special Judge under the NDPS Act, Nadia at Krishnagar.

On perusal of the instant application and having heard the learned Advocate for the petitioner, this Court is of the view that the instant revision can be disposed of here and now with the assistance of the learned Advocate appearing on behalf of the State.

Mr. Bibaswan Bhattacharya, learned Advocate be appointed in the instant matter to assist this Court on behalf of the State of West Bengal, opposite party herein.

Appointment of Mr.

Bhattacharya be regularized by the learned Legal Remembrancer, Government of West Bengal.

It is submitted by the learned Advocate for the petitioner that the petitioner was arrested by the police on 5th October, 2021 with an allegation that the petitioner was possessing narcotics substances illegally. Accordingly Palashipara Police Station Case No.376 of 2021 was registered against the petitioner under Section 21(C)/29 of the NDPS Act. Police submitted charge-sheet against the accused on 26th March, 2022. On 20th May, 2022 the Trial Court framed charge against the accused and the next date of evidence is fixed on 11th August, 2022. From the list of dates and submissions made by the learned Advocate for the petitioner, I do not find any laches on the part of the learned Trial Judge where a specific direction for expeditious disposal of the above-numbered case ought to be passed.

The instant revision is pre-matured and therefore, the same is dismissed.

However, dismissal of the instant revision will not prevent the accused to file similar petition after the prosecution fails to examine witnesses in the Trial Court on the date fixed for trial.
