Mr. Ankit Agarwala Ms. Alotriya Mukherjee Mr. Arpita Paul Biswas ....for the petitioners Ms. Debleena Dasgupta ....for the State The petitioner has prayed for implementation of an order dated November 12, 2028 passed by the West Bengal Land Reforms and Tenancy Tribunal in O.A. No.1702 of 2017.

By the said order the learned tribunal passed a direction upon the concerned Block Land & Land Reforms Officer to hear and dispose of the petitioners' application dated January 4, 2016 in accordance with law after giving an opportunity of hearing to all interested parties and within the time limit as indicated in the said order. The petitioners have alleged non-compliance of the order passed by the tribunal.

That apart, the petitioners alleged inaction on the part of the authorities under the West Bengal Land Reforms Act, which is a specified Act under Section 2(r) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997. An alternative efficacious remedy is available under the 1997 Act.

For such reason this Court is not inclined to entertain this writ petition.

Faced with such situation, the learned advocate appearing for the petitioner prays for leave to withdraw this writ petition with liberty to approach the appropriate forum.

In the light of the submissions made by the learned advocate for the petitioner, WPA 14088 of 2023 stands dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law. There will be no order as to costs.
