The petitioner has filed the present application being CAN 1 of 2024 praying for recalling of the order dated 20.11.2024 wherein this Court has dismissed the writ application for default for none appearance of the parties on call.

2. Learned counsel for the petitioner submits that the writ petition was dismissed for default by an order dated 20.11.2024 and immediately on 10.12.2024 the petitioner has filed the present application.

3. This Court did not find any reason shown by the petitioner why the petitioner has not appeared before this Court when the matter is called.

4. Learned counsel appearing for the respondents has also raised the objection and submits that though the petitioner has filed the application for recalling of the order but has not shown any reason why the petitioner has not appeared before this Court when the matter is called.

5. Learned counsel for the petitioner submits that this is the transferred brief and as such he requires some time to file supplementary affidavit to assign the reason why the petitioner or the learned advocate for the petitioner had not appeared before this Court.

6. This Court finds that the petitioner has filed the present writ petition in the year 2019 and the writ petition was dismissed by an order dated 20.11.2024. Since the year of 2024 the petitioner has not moved the application, when today the petitioner moved the application and this Court has found that there is no reason has been shown, now the petitioner intend to file a supplementary affidavit which is not acceptable.

7. Accordingly, CAN 1 of 2024 is dismissed.
