Learned counsel appearing for the petitioner submits that the petitioner is the widowed daughter of Late Harihar Pattabayak and that the District Inspector of Schools has already forwarded the application and relevant documents to the Director of Pension, Provident Fund & Group Insurance, West Bengal, Purta Bhaban (2nd Floor), Salt Lake City, Kolkata-91 being the respondent no.2 in the instant applicant. However, the said application and documents have not been considered by the respondent no.2 till date.

The respondent no.2 is directed to issue a prior notice of at least 7 days, to the petitioner and after granting her an opportunity of hearing, dispose of the representation regarding sanction of family pension strictly in accordance with law. All the procedures laid down under the relevant rules shall be strictly followed while

considering the representation. The entire exercise shall be carried out and completed by the respondent no.2 and/or any other relevant State authorities within a period of eight weeks from date of communication of this order and the reasoned order shall be communicated to the petitioner within a period of two weeks from the date of reasoned order to be passed.

It is made clear that, this Court has not gone into the merits of the claim of the petitioner and the petitioner shall be at liberty to urge all points she wishes to raise, by relying upon such records and documents, as she may choose to place before the respondent no.2.

The Writ petition being WPA 13948 of 2025 is accordingly disposed of.

There will be no order as to costs.

Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied.
