And In Re : Ibrahim Shaikh ..... petitioner Mr. Prabir Majumder ... for the petitioner Ms. Zareen N. Khan Md. Kutubuddin ... for the State Learned Counsel appearing for the petitioner submits that his client is in custody for 101 days. It is also submitted that the petitioner has been falsely implicated in the instant case.

Learned Counsel appearing for the State opposes prayer for bail.

We have considered the materials on record including statements of the eye-witnesses under Section 164 of the Code of Criminal Procedure who state that the petitioner was a member of the group who were variously armed and assaulted the victim resulting in his death.

In view of gravity of the offence and prima facie involvement of the petitioner therein, we are not inclined to grant bail to him at this stage.
