Krishnendu Pal & ORS v. Govt Of Wb & ORS
28.07.2023 Item No.65 Ct. No.5 CHC (dismissed) WP.ST 134 of 2014 Krishnendu Pal & ors.
Vs.
Government of West Bengal & ors.
Mr. Rama Prasad Sarkar ...for the writ petitioners The writ petition is directed against an order dated June 28, 2013 passed by the West Bengal Administrative Tribunal in O.A.780 of 2012.
By the impugned order, the Tribunal dismissed the Original Application of the writ petitioners challenging the selection process. The writ petitioners participated in a selection process for recruitment of Group-D staff in the Food and Supplies Department initiated by an advertisement.
The petitioners alleged before the Tribunal, and reiterated such allegations before us that appointing authority without following the due process of recruitment prepared a list of candidates only to accommodate their own men. It was alleged before the Tribunal and reiterated before us that, the private respondents did not appear or did not qualify in the selection process but were given the appointment.
Before the Tribunal, the State appeared and filed response to the Original Application. In such response, the allegations were denied. Before the Tribunal, the State claimed that, petitioners did not arrive within the zone of consideration and therefore, were not included in the panel prepared.
There is no material before us to substantiate any of the allegations made by the petitioners.
The petitioners participated in a selection process without any protest. Apparently, an interview was held and a penal was prepared. The writ petitioners were unsuccessful in the selection process. It is thereafter that, these allegations were sought to be levelled. That apart, selection process relates to a period prior to 2012. The Original Application was disposed of by the impugned order of June 28, 2013.
At this belated stage, we are not minded to interfere.
In such circumstances, we find no merit in the present writ petition.
WP.ST 134 of 2014 is dismissed without any order as to costs.
