Petitioner is aggrieved by the manner in which investigation was conducted by Narkeldanga Police Station in connection Narkeldanga PS Case No. 325 dated 04.11.2021. Police authorities initially submitted a final report in connection with the said case. Pursuant to which the petitioner submitted an application under section 173(8) of the Cr.P.C and by an order dated 09.01.2023 the learned ACJM, Sealdah was pleased to direct the Officer-in-Charge, Narkeldanga Police Station to direct investigation further by an officer of his choice except the previous investigating officer.

Presently it has been submitted that the investigation is proceeding but police authorities could not lay their hands on any fresh materials to be furnished before the court.

Learned advocate for the state has submitted a report of the Officer-in-Charge, Narkeldanga Police Station. The said report is not very inspiring. So far as the efforts of the police authorities are concerned. Accordingly Narkeldanga Police Station Case No. 325 dated 04.11.2021 is transferred to the Anti Dacoity Section, Detective Department, Lalbazar, Kolkata for further investigation.

The Assistant Commissioner in charge of the said section would deploy an officer of his choice for tracing out the materials. A monthly progress report be submitted before the learned ACJM, Sealdah by the concerned investigating officer.

With the aforesaid observations WPA 14095 of 2023 is disposed of.
