In view of repeated non-appearance on behalf of the State, Mr. Mir Anuruzzaman, Advocate, who usually appears on behalf of the State, is requested to enter appearance on behalf of the State with his junior, Mr. Biswajit Dutta, Advocate. The services of Mr. Anuruzzanam and Mr. Dutta be regularized by the Legal Remembrancer.

This is a writ petition complaining of alleged illegal encroachment of the land belonging to the petitioner. It is submitted on behalf of the petitioner that despite the filing of several representations, the respondents have taken no steps in the matter till date.

Mr. Anuruzzaman, Advocate on behalf of the State, submits that the State has no objection if the representation of the petitioner is considered in

accordance with law after giving a right of hearing to the petitioner and all concerned.

In view of the above, W.P.A. No. 14097 of 2023 stands disposed of by directing the respondent no. 5 to consider the representation of the petitioner dated April 21, 2023 and pass a reasoned order within a period of eight weeks from date after giving a right of hearing to all concerned.

It is made clear that there has been no adjudication on the merits of the case and all points are left open to be decided by the respondent no. 5 in accordance with law.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
