Saha ... for the respondent no.12 The petitioner complains that his information which was sent on March 25, and subsequently, on repeated occasions were not acted upon by the Officer-in-charge of Dhaniakhali Police Station and/or superior officers.

Learned advocate for the State has submitted a report which reflects that there is a private dispute amongst the brothers of the petitioner. However, the

police authorities failed to find out any cognizable offence and/or non-cognizable offence for proceeding with the nature of the dispute.

Having considered the stand of the State and the submissions of the learned advocates for the respective parties that there are specific allegations against the BL&LRO, I am of the opinion that present BNSS provides statutory provisions for proceeding against any public servant.

Accordingly, the petitioner would be at liberty to approach the jurisdictional Magistrate in respect of the accusations.

The learned Magistrate would assess as also ascertain the authenticity of the accusations, thereafter, pass necessary directions as it deems fit and property.

In the meantime, the police authorities would continue their surveillance as also ensure that no breach of the

peace and/or tranquility takes place.

With the aforesaid observations, WPA 14014 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
