Mr. Tarapada Das Mr. Mahadeb Khan ..for the petitioner Mr. Swapan Banerjee, Ld. A.G.P Ms. Debdooti Dutta ..for the State Mr. Sanjay Saha Mr. Raju Mondal ..for the respondent no.5 preliminary objection with regard to the maintainability of the writ petition has been raised by Mr. Banerjee, learned Additional Government Pleader. The learned advocate representing the West Bengal Mineral Development and Trading Corporation Limited also raises an objection as to the maintainability of this writ petition.

Learned advocates for the respondents uniformly submit that none of the rights of the petitioner has been affected but the petitioner seeks to espouse the cause of the general public.

Faced with such situation, the learned advocate for the petitioner prays for leave to withdraw this writ petition with liberty to approach the appropriate forum in accordance with law.

In the light of the submissions made by the learned advocate for the petitioner, WPA 13969 of 2025 stands dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum for the self same cause of action.
