In re : CRAN 2 of 2025

1. By an order dated September 19, 2024, a Coordinate Bench had granted bail to the applicant herein, inter alia, on the condition that he shall remain within the city of Kolkata and provide his residential address to the investigating agency as well as the Court below.

2. The applicant now seeks relaxation of the aforesaid condition restricting him to the limits of the city of Kolkata. He says that he has been strictly complying with the conditions of bail. Twice he was granted interim bail and after the periods of interim bail expired, he surrendered back to the correctional home. He says that for one and a half years he has not left the city of Kolkata. He would like to visit his daughter in Delhi. He should be allowed to travel within India. He has no intention of going abroad at this moment.

3. Learned State Counsel, in his usual fairness, says that on an earlier occasion, similar restrictive condition was relaxed by a Coordinate Bench and a co-accused was allowed to travel within India.

4. To our query as to whether or not the applicant has complied with the conditions of bail, learned State Counsel says that there is no adverse report in that regard.

5. We find that the passport of the applicant remains deposited with the learned Trial Court. His passport will remain so deposited until further orders.

6. We see that the investigation is still going on. Nobody can say when the investigation will conclude. Taking a reasonable view of the matter, we are inclined to allow the applicant's prayer and we hereby permit him to travel within the territorial limits of India.

7. The other conditions of bail remain unaltered.

8. CRAN 2 of 2025 is disposed of.
