2025-07-25Hon'Ble Justice Suvra Ghosh2 pages

July 25, 2025 32 ARDR CRM (M) 842 of 2025 In Re : An Application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Nischinda Police Station Case No. 69 of 2024 dated 08/6/2024 under Sections 302/120B/34 of the Indian Penal Code.

And In Re :

Sumona Dey ... petitioner.

Adv. Soumyajit Das Mahaptra, Adv. Soumya Basu Roy Chowdhury, Adv. Madhurai Sinha, Adv. Upasana Banerjee ...for the petitioner.

Adv. Bitashok Banerjee, Adv. Madhumita Basak, ...for the State.

The petitioner is in custody for about a year and prays for bail. Learned counsel for the petitioner takes this Court to the evidence of the defacto complainant (PW 1) and PW 2E who have turned hostile.

Learned counsel for the State opposes the prayer. I have considered the material on record.

The witnesses have implicated the petitioner in their statements recorded under Section 161 of the Code of Criminal Procedure. Vulnerable witnesses are yet to be examined.

In the event the petitioner is released on bail at this stage, possibility of winning over/intimidating the witnesses cannot be ruled out.

Considering the material on record, prayer for bail is rejected at this stage.

Learned trial Court is directed to examine the vulnerable witnesses at the earliest.

The application for bail is disposed of.

Case Diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
