Mr. Sourav Mondal ......for the petitioner Mr. Tarak Karan .....for the State Learned counsel appearing for the petitioner submits that there are some incurable defects in the writ petition. As such, he would not like to press the same and would instead file a fresh application on the self-same grounds.

On the prayer of the learned counsel appearing for the petitioner, the writ petition is dismissed as withdrawn.

However, this order shall not preclude the petitioner from filing an appropriate application afresh on the self-same grounds.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
