The State of West Bengal and others Mr. Akash Dutta, Mr. Aninda Chakraborty .... for the petitioner Learned counsel for the petitioner submits that the petitioner sought information regarding alleged illegal conversion of a pond under the Right to Information Act. However, the first forum, that is, the respondent no.3, did not furnish such information. As a consequence, the petitioner preferred an appeal before the appellate authority, that is, the respondent no.2.

The respondent no.2/appellate authority directed the respondent no.3 to furnish the necessary information by its order passed dated March, 2023. However, till date, such information has not been furnished by the respondent no.3.

It is submitted by learned counsel for the petitioner that service has been properly effected on all the respondents. On the prayer of the petitioner, the petitioner is directed to file the affidavit-of-service during the course of the day.

In view of the innocuous nature of the prayer, further service is not being directed.

WPA No. 14110 of 2023 is disposed of by directing the respondent no.3 to immediately comply with the direction of the respondent no.2 by way of furnishing the necessary information, as directed by the respondent no.2, to the petitioner.

It is expected that such information shall be furnished as expeditiously as possible, positively within three weeks from the date of communication of this order to the respondent no.3. The petitioner shall serve a server copy of this order, on which the respondent no.3 shall act in order to comply with the direction given above.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
