Learned Advocate appearing for the petitioner submits that the petitioner was not named in the first information report. The petitioner was falsely implicated in the charge-sheet submitted by the police. The petitioner is en employee of Government Railway Protection. The petitioner was on duty at the material point of time.

The learned Advocate appearing for the State draws the attention to the materials in the case diary including the statement recorded under Section 164 of the Code of Criminal Procedure.

The statement of the eye witnesses recorded under Section 164 of the Code of Criminal Procedure implicates the petitioner in the offence of murder.

In such circumstances, we are unable to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected. CRM (A) 3216 of 2022 is dismissed.
