Versus

Sunil Dutta @ Sunil Chandra Dutta sg Ct. 6 [ Mr. Subhajit Chowdhury Mr. Sujan Das Mr. Binay Shaw Ms. Esha Basak ...for the petitioner The petitioner is aggrieved by the order dated 8th June, 2026 whereby a date for hearing of the injunction application and for acceptance of the counter claim has been fixed after about 9 months i.e. on 9th March, 2027. The learned Advocate appearing for the petitioner submits that the petitioner is suffering from serious illness. He prays that the date of hearing of the injunction application and for acceptance of the counter claim be preponed and the proceeding be disposed of expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioners shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith.

In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by giving liberty to the petitioner to file an application for pre-ponment of the next date of hearing before the learned Trial Judge after serving a copy of the same to the learned Advocate for the opposite party.

If such an application is filed, the learned Trial Judge is requested to consider the same sympathetically

taking into consideration the physical condition of the petitioner.

The learned Civil Judge (Junior Division), 1st Court, Barasat, North 24 Parganas is requested to make all endeavour to dispose of the Title Suit No. 47 of 2025 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requite formalities.
