The petitioners allege that their prayer for granting benefit under the Price Variation Clause is pending consideration at the end of the railways for a considerable period of time.

After hearing the parties and considering the case stated in the writ petition, I dispose of the instant writ petition directing the third respondent - Senior Divisional Engineer (2), Eastern Railways - to consider the petitioners' representation dated January 11, 2022 (Annexure P9, p.147) in accordance with the prevailing rules, after affording hearing to the petitioners and by passing a reasoned order, at the earliest but positively within a period of eight weeks from the date of communication of this order.

If any amount is found due and payable under the Price Variation Clause, the same shall be credited in favour of the petitioners forthwith. 4.

Learned counsel for the petitioners shall forward a copy of the representation dated January 11,

2022 along with all supporting documents to the said respondent at the time of communication of this order.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
