1. The parties are represented through their respective Counsels.

2. Pursuant to the order dated 03.11.2025 the petitioner was directed to file supplementary affidavit given a comprehensive detailed report by giving a break up and the statement of accounts in a tabulated form pertaining to the entitlement of the workmen who are added in the instant proceedings. In pursuance to such direction the petitioner has filed the supplementary affidavit affirmed on 13.11.2025 and the same is kept on record and a copy of the same has also been served to the respective parties through e-mail dated 13.11.2025 to the State and the Canara Bank.

3. The petitioner wishes to withdraw the instant writ petition since already an appeal has been preferred before the Deputy Labour Commissioner and the money as indicated in the order dated 23.04.2025 at page 15 has been deposited in the treasury on 16.09.2025 which is evident from page 12 of the supplementary affidavit.

4. The petitioner submits that all the 10 workers have been paid by Merlin Projects Limited which is a subject matter of the civil suit. But in respect of one worker namely, Md. Afzal Hussain whose money has been deposited in the Alipore Treasury and the same is evident from page 5 of the supplementary affidavit.

5. In view of above, I find that there is no issue left to be adjudicated or to be considered.

6. Thus, writ petition being no. WPA 14000 of 2025 is disposed of in view of the documents annexed to the supplementary affidavit.

7. Interim order, if any, shall stand vacated. (Smita Das De, J.)
