1. It is submitted on behalf of the accused/petitioners and the de-facto complainant/opposite party that a settlement has been arrived at between them and the de-facto complainant has no objection if anticipatory bail granted to the petitioners.
2. Learned Public Prosecutor representing the State opposes the prayer for anticipatory bail.
3. Perused the case diary.
4. As the matter pertains to certain commercial transactions between the private parties and it is submitted on behalf of the petitioners and the de-facto complainant that a settlement has been arrived at between them, I am
inclined to allow the application for anticipatory bail to the petitioners.
5. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner no. 3 shall meet the I.O as and when required.
6. Accordingly, the application for anticipatory bail is allowed.
7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
