Mr. Aniket Mitra Mr. Shibasish Banerjee ... for the State Learned Counsel appearing for the petitioner submits that his client is in custody for 105 days. It is also submitted that co-accused has been granted bail.

Learned Counsel appearing for the State opposes prayer for bail. He submits motor cycle was demanded by the petitioner/husband. As such demand could not be met, victim was tortured and committed suicide.

We have considered the materials on record. Demand of motor cycle was for the petitioner. As demand was not met victim housewife was tortured. Accordingly, he does not stand on the same footing with co-accused Kalpana Das, mother-inlaw of the victim, who has been granted bail. In view of aforesaid facts and circumstances of the case disclosing prima facie involvement of the petitioner in the crime, we are not inclined to grant bail to him at this stage.
