Learned advocate appearing on behalf of the petitioner submits that the petitioner is in custody for about 51 days. According to the learned advocate he is innocent of the charges and having regard to the period he has already undergone, on stringent condition the petitioner submits that he may be released on bail.

Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the injury report as well as the statement of the witnesses.

Prima facie, there are materials, however, having regard to the period of detention undergone by the present petitioner, we are inclined to release the petitioner on bail.

Accordingly, the present petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees ten thousand only)

with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Kandi, Murshidabad.

If on bail, the petitioner shall meet with the Investigating Officer of the case once in a week till submission of the charge-sheet. In case the petitioner leaves the jurisdiction of the sub-division of Kandi, he shall inform the Inspector-in-Charge of the concerned Police Station.

Any violation of the conditions afore-mentioned will entitle the learned ACJM, Kandi, Murshidabad to cancel the bail of the petitioner without further reference to this Court.

Thus, the application for bail, being CRM(DB)1724 of 2024, is allowed.
