Salim, Advocates ... for the petitioner Ms. Faria Hossain, Ms. Sonali Das, Advocates ... ... for the State Mr. Basu, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated and the complaint had been lodged about seven months after the alleged incident. Upon completion of investigation, charge-sheet has been submitted and as such further detention of the petitioner, who is in custody for about 1 year 4 months, is not necessary. He further submits that the medical report does not corroborate the statement of the victim girl.

Learned advocate appearing for the State opposes the prayer for bail and draws our attention to several documents in the case diary including medical report, the statement of the victim girl, as recorded under Section 164 of the Cr.P.C.

Having heard the learned advocates appearing for the respective parties and considering the materials in the case diary, the gravity of the offence, the statement of victim girl as recorded under Section 164 of the Cr.P.C. and the extent of complicity of

the petitioner in the alleged offence, we are not inclined to grant bail to the petitioner.

As such the prayer for bail is refused at this stage. Accordingly, the application for bail being C.R.M. 6130 of 2021 is dismissed.
