Learned counsel for the petitioner submits that the FIR maker has turned hostile. The petitioner is in custody for about a year and may be granted bail.
I have considered the material on record.
The statement of the minor son of the petitioner recorded under Section 164 of the Code of Criminal Procedure implicates the petitioner in the alleged crime.
Vulnerable witnesses including the minor are yet to be examined.
The petitioner is in custody for about a year. The offences, if proved, shall attract mandatory life imprisonment.
Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.
The application for bail is disposed of.
