The revisional application was preferred challenging the proceeding being Case no. G.R. No.630 of 2006 arising out of Gurup P.S. Case No.41 of 2006 dated 12.7.2006. Records of the revisional application reflect that there was a direction upon the petitioner to effect service upon the office of the Public Prosecutor and upon the private opposite party. However, none apprised this court regarding the issue of service being effected as such Mr. Imran Ali, learned advocate, who ordinarily appears for the State, is directed to appear in this matter and represent the State. His appointment may be regularized by the concerned authority.

Having regard to the fact that the petitioner approached this Court when the charge sheet was filed before the jurisdictional Court and the cognizance was taken by the Learned Magistrate, further as the stage of Section 207 of the

Code of Criminal Procedure was not complied with, I am of the opinion that the revisional application was filed at a premature stage and as such no interference is called for. Accordingly, CRR 2138 of 2008 is dismissed.

All pending connected applications, if any, are consequently disposed of.
