Sufficient grounds have been made out explaining the absence of the petitioner's counsel on August 17, 2022. The order dated August 17, 2022 is recalled. Hence, the writ petition is restored to its original file and number.

Accordingly, CAN 1 of 2022 is allowed and disposed of.

The petitioner complains of inaction on the part of the Bauria Police Station in respect of a complaint dated April 25, 2022. The

complaint has also been sent to the Police Commissionerate, Howrah Urban and Rural Department, Howrah.

The police are represented.

The private respondent is not represented.

The police submit that the private respondent/daughter-in-law has filed a complaint against the petitioner which is registered as FIR No. 783 of 2012 dated 31.12.2012. Police have investigated into the subject FIR and filed charge sheet being Sankrail PS Charge Sheet No. 229 of 2013 dated 30.04.2013, inter alia, under Sections 498A/327/34 of the IPC and Sections 3 and 4 of the D.P. Act.

The petitioner's grievance against the private respondent/daughter-in-law, that she is appropriating sums of money from the account of the petitioner, has also been enquired into. The mother of the respondent no.5 had received sums of money from the said account on 16.02.2017, 17.02.2017, 18.02.2017, 20.02.2017 and 21.02.2017 which are stated to be towards her maintenance.

Mr. Sarkar, learned counsel appearing for the petitioner vehemently denies the same.

In those circumstances, this Court is of the view that the petitioner may approach the Magistrate under Section 156(3) of the Cr.

P.C. in accordance with law and seek redressal against any inaction of the police. 11.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

The report of the Rajapur Police Station dated 12.07.2022 is kept with the record.

14.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
