19.07.2024 Item no. 15.

Court No.28.

AB (Rejected) CRM (DB) 1740 of 2024 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure in connection with Titagarh P.S. Case No. 504 of 2023 dated 8.11.2023 under Sections 302/34 of the Indian Penal Code And In the matter of : Hasan Raja @ Arman ......Petitioner.

Mr. Debasish Kar ......for the Petitioner.

Ms. Amita Gour, Mr. Rahul Ganguly ......for the State.

The petitioner says that he is in custody for about nine months. Witness action has not yet begun. There is no certainty as to when the trial will conclude. He should be granted bail. Learned Advocate for the State shows us from the case diary that there is sufficient incriminating material against the petitioner. There are at least three eyewitnesses. The offending weapon was recovered from this petitioner. July 30, 2024, has been fixed as the date for examination of witness. There are 27 charge sheet named witnesses. All of them may not be examined.

Considering the incriminating material against this petitioner and the nature and gravity of the alleged crime i.e. murder, we are not inclined to grant bail to the petitioner, at this stage.
