Shib Ch.Kumar v. The State
23.08.2022 S/L No.56 KS C.R.R. 2392 of 1997 Sri Shib Charan Kumar -Vs.- The State of West Bengal & Ors.
Mr. Arijit Ganguly Mr. Sanjib Kumar Dan .....For the State The revisional application was preferred in the year 1997 challenging the charge-sheet No.29/96 dated 15.09.1996 corresponding to G.R. Case No.291/96 which was at the relevant point of time pending before the Learned S.D.J.M., Purulia.
Records reflect that till date the revisional application has not been admitted. As none appears on behalf of the State, Mr. Sanjib Kumar Dan, learned advocate who ordinarily represents on behalf of the State is directed to represent the case. His appointment may be regularized by the concerned authority.
Having regard to the subject-matter of the case which was under the provisions of Section 147/ 148/ 323/ 506/ 109 of the Indian Penal Code and Section 9(b) of the I.E. Act and the fact that none of the documents under Section 207 of the Code of Criminal Procedure were enclosed alongwith the revisional application substantiating the grounds on which the charge-sheet has been submitted, I am of the opinion that after 25 years have lapsed, the same do not call for any interference by this Court.
According, C.R.R. 2392 of 1997 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court. (Tirthankar Ghosh, J.)
