There is a complaint, filed by the writ petitioner, before the authorities, that is, the Chief Election Commissioner, Election Commission of India, District Magistrate, South 24 Parganas, Commissioner of Police, Kolkata Police and the Deputy Commissioner of Police, South Suburban Division.

The allegation principally is of threatening, harassing and hindering due disposition of party works of the members and supporters of the particular political party in the wake of election process which is going on at present.

Before the said authorities, the writ petitioners have prayed for transfer of the concerned police officer, for the purpose to bring peace and tranquility.

Mr. Anuran Samanta is appearing on behalf of the Election Commissioner.

He submits that on receipt of the complaint adequate steps have been taken through the appropriate respective authorities.

Mr. Somnath Ganguly is appearing for the State respondents.

He says that according to the report of the respective authorities there has not been any such incident of threatening etc, as alleged.

He alleges that the writ petitioners have come up with vexatious petition containing some vague and untrue allegations. A report to that effect has been submitted before the Election Commissioner.

Under the circumstances, this Court do not find any merit in the present writ petition.

Mr. Amit Halder for the writ petitioner has tried enough to convince the Court about the apprehending threat.

That, in the considered opinion of the Court, is a premature one to be dealt with, in the present writ petition.

The writ petition is dismissed.
