(VIA VIDEO CONFERENCE) Mr. Polash Chandra Poddar ...for the petitioners Mr. Chandi Charan De Mr. Ram Chandra Guchait ...for the State On the prayer made by the learned counsel appearing on behalf of the petitioner liberty is given to the petitioner to add The Special Land Acquisition Officer, Darjeeling as respondent no. 7 in the writ petition. It is submitted by the learned counsel appearing on behalf of the petitioners that the petitioners' land located in Budharugaon and Dhakpara has been acquired by the State-respondents for construction of river guard in 1994 but no compensation has been paid for the same. The petitioners filed a representation before the respondent no. 7 on October 27, 2009 which has not been considered till date.

Having considered the submissions made by the learned counsels appearing on behalf of the parties and the material on record, I dispose of the writ petition with a direction upon the respondent no. 7 to consider and dispose of the representation filed by the petitioners on October 27, 2009 within a period of three months from the date of communication of this order, after giving

reasonable opportunity of hearing to all the affected parties including the petitioner, in accordance with law. With the above observations and directions this writ petition being WPA No. 15110 of 2017 is disposed of. There shall be, however, no order as to costs. Since no affidavit in opposition is invited, the allegations contained in the petition are deemed not to be admitted.
