The proceeding stemps under Section 401 read with Section 482 of the Code of Criminal Procedure seeking an order to quash the proceeding.

The brief fact is stated that the petitioner was arraigned in Jadavpur P.S. Case No. 104(3) of 2004 as an accused for allegedly committing an offence under Sections 420/406 of the Indian Penal Code. The petition was filed before the learned J.M. 7th Court, Alipore seeking an order of discharge. The learned Trial Court having considered the materials made available before him was pleased to reject the application.

I do not find anything in the impugned order to hold that the same is a manifestation of miscarriage of justice. The petition under consideration is devoid of merit and stands dismissed. (Siddhartha Roy Chowdhury, J.)
