sg Ct. 6 [ Mr. Amitabha Ghosh Ms. Arpita Paul Biswas ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the Learned Civil Judge (Senior Division), 3rd Court at Barasat, North 24 Parganas to dispose of Title Suit No. 303 of 2019 expeditiously.

The learned Advocate appearing for the petitioner submits that the hearing of the suit was being adjourned from time to time.

After going through the order sheets appended to this civil revisional application, this Court finds that the adjournment was prayed for by the learned advocate on account of resolution taken by the local Bar Association. It further appears from the order sheets that for a certain period the hearing of the suit could not be taken place as the Presiding Officer was deployed in SIR related works prior to commencement of the Assembly Election of the State of West Bengal in April, 2026.

When this fact is pointed out to the learned advocate for the petitioner, he submits, on instruction, that the petitioner being the plaintiff in the suit, shall take steps in the suit in spite of any resolution being adopted by the local Bar Association.

Such submission of the learned Advocate for the petitioner is placed on record.

In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioners shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith.

In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division), 3rd Court at Barasat, North 24 Parganas to make all endeavour to dispose of the Title Suit No 303 of 2019 as expeditiously as possible without granting any unnecessary adjournment to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requite formalities.
