05.07.2023 sdas rejected C.R.M.(DB) No. 2405 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Raiganj Women Police Station Case No. 136 of 2019 dated 01.08.2019 under Section 376D of the Indian Penal Code read with Section 6 of the POCSO Act.

And In Re : Latifur Rahaman @ Bullet .... petitioner Mr. Ashok Halder Ms. Reshmi Mukherjee ....for the petitioner Ms. Zareen N. Khan Mr. Ashok Das ...... for the State Learned Counsel for the petitioner submits he is in custody for over 1000 days. It is contended that he has been falsely implicated. He prays for bail.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Victim has implicated the petitioner in the offence of penetrative sexual assault. Keeping in mind the aforesaid materials on record and gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.

Trial court is directed to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties.
