Writ petitioner is a retired headmistress of Mukhvadhir Vidyamandir, Kolkata and retired on superannuation on 31st August, 2020. After superannuation of the writ petitioner her pension case was duly processed by the respondent authorities and ultimately on settlement of retiral dues pension payment order was issued vide Memo dated 7th May, 2021, page 30 of the writ petition. The grievance of the writ petitioner is non-payment of retiral dues as per the said pension payment order due to want of no liability certificate which is required to be issued by the authority of Mukhvadhir Vidyamandir, Kolkata.

Mr. Paul, learned advocate appears on behalf of Mukhvadhir Vidyamandir including the teacher-in-charge of the said school and files no

liability certificate before this Court which has been signed by the teacher-in-charge of the said school on 30th September, 2021. Such no liability certificate issued on behalf of the said school authority is taken on record.

The State respondents are represented by Mr.

Chattopadhyay, learned Sr.

Government Advocate duly assisted by Ms. Dutta, learned advocate. It is submitted on behalf of the State respondents that since no liability certificate has already been issued by the school authority there is no impediment in releasing retiral dues in favour of the writ petitioner.

Considering the submissions made on behalf of the respective parties to this writ petition including the issuance of no liability certificate on 30th September, 2021 this Court directs the respondent authorities including the Joint Director (P.D.O) PD Cell being respondent no.11 to take expeditious steps for release of retiral dues in favour of the writ petitioner as per the said pension payment order dated 7th May, 2021 at an early dated but not later than six weeks from the date of communication of this order.

With the above direction, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
