22.09.2021 rrc CRM 6145 of 2021 In re : An application under Section 439 of the Code of Criminal Procedure, 1973 in connection with Kotwali Police Station Case No. 191/20, dated 16.03.2020, under Sections 325/308/34 of the Indian Penal Code, 1860.

In the matter of : Suraj Sk alias Suroj Sk ..... petitioner Mr. Kusal Kumar Mukherjee ....For the petitioner Mr. Abhra Mukherjee Mr. Dipankar Mahata .....For the State It has been submitted by the learned advocate for the petitioner that the petitioner is in custody for about 210 days. It has further been submitted that other accused persons have been granted bail by this Court on August 26, 2021. Having regard to the period of detention undergone by the petitioner and in view of the fact that charge-sheet has already been submitted in this case, I am of the opinion that there is no necessity to detain the petitioner in custody further. Accordingly, the prayer for bail of the petitioner is allowed subject to furnishing a bond of Rs.

10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the learned Sessions Judge, Nadia, and with further condition that the petitioner shall be leave the jurisdiction of the local police without permission from the Officer-in-Charge of the said police station, he will not influence the witnesses and/or tamper with evidence, and with a further condition that he shall attend day to day trial before the learned Judge in the Court below.

In the event the petitioner fails to appear before the trial court without any justifiable cause, the learned Magistrate in the Court below will be at liberty to cancel the bail of the petitioner in accordance with law without further reference to this Court.
