The pre-emptor in a proceeding under Sections 8 and 9 of the West Bengal Land Reforms Act, 1955 is the petitioner of the present application under Article 227 of the Constitution of India.

The petitioner is aggrieved by the order no. 2 dated September 4, 2021 passed in the said proceeding being J. Misc. Case No. 35 of 2021 pending before the First Court of learned Civil Judge (Junior Division), Contai, District: Purba Medinipur.

The learned Trial Judge by the order impugned has refused to pass an ad interim order of injunction on the application filed by the petitioner and has also decided to consider the prayer of the petitioner for holding local inspection of the suit property after notice to the other side. The course adopted by the learned Trial Judge cannot be faulted, this Court, therefore, does not find any reason to interfere with the order impugned.

CO 1647 of 2021 is disposed of with the request to the learned Trial Judge to expedite the disposal of the said two applications in accordance with law.

There shall be no order as to costs.
