Mr. Pulakesh Bajpayee ...for the petitioner Mr. Sunil Gupta Mr. Hazibul Islam ...for respondent no.5 The petitioner is aggrieved by the inaction on the part of the Murshidabad Zilla Parishad in not finalizing the temporary settlement in terms of the notice dated April 17, 2023. The settlement is for the period between 2023-24 and 2025-26.

Representation dated May 15, 2023 (Annexure P2, p.17) filed by the petitioner before the Sabhapati of the Murshidabad Zilla Parishad is pending consideration.

Relying upon the memorandum issued by the Secretary to the Government of West Bengal, Finance Department being No.9754-F(Y) dated December 3, 2012, the Zilla Parishad allegedly cancelled the settlement process.

On perusal of the aforesaid memorandum, it appears that the same is for the purpose of purchase of goods and services. The memorandum does not relate to settlement of land.

In view of the above, the Murshidabad Zilla Parishad is directed to finalize the settlement notice in

accordance with law at the earliest, but positively by June 14, 2024.

In the event there is no restriction or impediment in settling the land in favour of the petitioner, the Murshidabad Zilla Parishad shall take steps to settle the same in favour of the petitioner within the time limit as specified hereinabove.

It is made clear that this order is restricted only in respect of the present petitioner.

The writ petition is disposed of.

Certified copy of this order, if applied for, shall be made available to the parties.
