For the petitioner : Mr. Soumya Basu Roy Chowdhuri For the State : Mr. Suman De Mr. Manoranjan Mahata Heard on : 08.07.2025 Judgment on : 08.07.2025 Jay Sengupta, J.:- This is an application praying for stay of warrant of arrest in respect of Sankrail Police Station Case no. 523 of 2019 dated 7.7.2019 corresponding to G.R Case no. 3076 of 2019.

Let a copy of this application be served upon Mr. Suman De and Mr. Manoranjan Mahata, learned counsels who ordinarily appear on behalf of the State. They are requested to represent the State in this case. Their engagement may be regularized in this case.

Learned counsel appearing for the petitioner submits as follows. The petitioner is an accused in this case and he was granted anticipatory bail by the Sessions Court. He surrendered and obtained bail. Thereafter, he attended the Trial Court. However, due to miscommunication with the learned counsel conducting the trial, he failed to appear before the learned Trial Court on few occasions. He wants to join the proceedings at the earliest.

Learned counsel for the State submits that the petitioner had remained absconding since 2023.

In view of the fact that the petitioner had avoided appearance before the learned Trial Court since 2023, this is not a fit case for granting stay of warrant of arrest. However, in the event, the petitioner surrenders before the learned Trial Court within four weeks from date and applies for bail, his application shall be considered in accordance with law. With the aforesaid observations, the revisional application is disposed of.
