Banerjee) Mr. Shubasish Sengupta Mr. Lalit Baid Mr. Akash Munshi Ms. Sanjana Shaw Ms. Sudeshna Ghosh ...for the petitioner The applicant under Section 34 of the Arbitration and Conciliation Act, 1996 has filed this application under Article 227 of the Constitution of India praying for a direction upon the learned Judge, Commercial Court at Alipore to dispose of Misc. Arbitration (Com.) No. 73 of 2023 expeditiously. Learned advocate appearing for the petitioner submits that the application being IA 1 of 2023 which was filed for stay of the operation of the arbitral award, is pending from the year 2023 and the award has already been put into execution.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this

order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge.

From the order-sheets appended to this application this court finds that July 5, 2025 has been fixed for hearing the application being IA 1 of 2023.

It further appears from the order dated May 19, 2025 that the arguments of the respondent in the miscellaneous case was heard in part and July 5, 2025 has been fixed for further hearing of the application on behalf of the respondent in the said miscellaneous case.

In view thereof, CO 2248 of 2025 stands disposed of by requesting the learned Judge, Commercial Court at Alipore to take up the haring of IA 1 of 2023 on the next date fixed, i.e., on July 5, 2025 and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
