Tapash Mahakal v. State Of West Bengal
(AD) 08.12.2021 C.R.M. 6154 of 2021 (Via Video Conference) Court No.28 (Rejected) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Panchla P.S. Case No.78 of dated 14/03/2017 under Sections 448/325/307/302/354B/379/506/34 of the Indian Penal Code, corresponding to G.R. No.1512 of 2017.
And In the matter of: Tapash Makhal ....petitioner.
Mr. Jayanta Narayan Chatterjee Mr. Debashis Banerjee Mr. Nazir Ahmed Mr. Supreem Naskar Ms. Jayashree Patra Ms. Ritushree Banerjee ...for the petitioner.
Mr. N. Ahmed Ms. Ayantika Ray ... for the State.
Petitioner renews the prayer for bail. He submits that he has been falsely implicated in the instant case. Learned Advocate appearing for the State submits that petitioner is one of the principal assailants. We have considered the statement of witnesses prima facie disclosing the role of the petitioner as one of the principal assailants who assaulted the victim resulting in his death. Hence, we are of the opinion that this is not a fit case to grant bail.
Accordingly, the prayer for bail of the petitioner is
rejected.
C.R.M. 6154 of 2021 is, thus, dismissed.
