Ms. Sumouli Sarkar ..for CESC Limited The petitioner seeks an electricity connection in respect of premises No. 34/14 (Part), Nabanaritala 1st Bye Lane, Post Office-Baksara, P.S. A.J.C. Bose, Botanical Garden, Howrah-711110.
The petitioner claims to have been in occupation of the said premises for the past forty (40) years. Mr. Gupta, learned counsel appearing for respondent no. 5, submits that the petitioner does not currently reside at the said premises.
Service of notice upon respondent nos. 4 and 6 has not yet been effected.
Learned counsel appearing for the Calcutta Electricity Supply Corporation (CESC) Limited submits that CESC had received an application seeking a new electricity connection in respect of premises No. 34 (Part), Nabanaritala 1st Bye Lane, Post Office-Baksara, P.S. A.J.C. Bose, Botanical Garden, Howrah-711110.
Upon conducting an enquiry, it was revealed that an existing service connection is already operative at the said premises. Accordingly, no further steps were taken by CESC Limited at that stage.
She further submits that no subsequent application has been received by CESC Limited seeking a new service connection in respect of 34/14(Part), Nabanaritala 1st Bye Lane, Post Office-Baksara, P.S. A.J.C. Bose, Botanical Garden, Howrah-711110. Having regard to the materials on record, I do not find any reason to keep the present writ petition pending.
Accordingly, the writ petition is disposed of, granting liberty to the petitioner to make a formal application for a new electricity connection in respect of premises No. 34/14 (Part), Nabanaritala 1st Bye Lane, Post OfficeBaksara, P.S. A.J.C. Bose, Botanical Garden, Howrah711110, in accordance with law. If such an application is submitted, the same shall be considered by CESC Limited strictly in accordance with law and expeditiously.
Accordingly, WPA 14067 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
