In the matter of : Dasmat Hembram.
... Petitioner.
Mr. Kalidas Saha.
...for the Petitioner.
Mr. Tanmay Kr. Ghosh, ld. SGA, Ms. Sonali Bhar.
...for the State.
Heard the learned Advocates appearing for the parties. Petitioner is in custody for about 52 days. He submits there was a love affair between the parties and he has been falsely implicated in the instant case.
Learned Advocate for the State opposes the prayer for bail.
We have considered the statement of the minor victim recorded under Section 164 of the Code of Criminal Procedure. She states she was forcibly ravished.
In view of the aforesaid incriminating materials on record, gravity of the offence and as investigation is in progress, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
