Mr. Sagar Saha Ms. Nayana Mukhopadhyay ...for the petitioner Mr. Aniket Mitra Ms. Jonaki Saha ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner was a friend of the deceased husband of the de facto complainant. The victim is now falsely claiming that the petitioner got married to him. The petitioner is of different faith. He is ready to comply with notice if the same is issued by the police and cooperate with investigation. Learned counsel appearing on behalf of the State submits as follows. After the husband's death, the victim purportedly got married to the petitioner in a temple. The victim's further grievances that the petitioner did not return a sum of Rs. 3 lakhs that he had taken from the victim and some gold.

Considering the nature of allegations and materials available in the case diary, I do not think custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall not threaten or intimidate witnesses and shall cooperate with investigation. The petitioner shall meet the I.O. once a fortnight till submission of report in final form. The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
