The present revisional application has been preferred challenging the impugned order dated 2nd March, 2016 passed by the learned Additional Chief Judicial Magistrate, Contai in Misc. Case No. 230 of 1993. By the said judgment and order, the learned Magistrate was pleased to allow the application under Section 125 of the Code of Criminal Procedure and awarded maintenance of Rs. 1,000/- per month to the wife and Rs. 900/- per month to the minor son from the date of the order. It is reflected that in the main application under Section 125 of the Code of Criminal Procedure, the opposite party wife claimed Rs. 500/- per month for self and Rs. 300/- per month for her minor son.
In course of arguments, a prayer was advanced before the learned trial Court for considering an enhanced amount as the case was filed in the year 1993 and the same continued till 2016. Having regard to the reasons so assigned by the learned Magistrate after assessing the evidence, the finding as well as the
quantum awarded as maintenance, calls for no interference by this Court.
Thus, the revisional application being CRR 1992 of 2016 is dismissed.
Pending applications, if any, are consequently, disposed of. Interim order, if any, is hereby vacated.
