Ct.No.28 as (Rejected) C.R.M. (DB) 2172 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Dhantala P.S. Case No.412 of dated 31.08.2021 under Sections 363/365/366B/370/34 of the Indian Penal Code and Section 13 of the Foreigners Act and Section 5 of the Immoral Trafficking (Prevention) Act, 1956.

In the matter of : Jasim Mondal.

... Petitioner.

Mr. Angshuman Chakraborty, Mr. S. S. Saha.

...for the Petitioner.

Mr. Ranabir Ray Chowdhury, Mr. Sujit Gupta, Mr. Mainak Gupta.

...for the State.

Heard the learned Advocates appearing for the parties. Petitioner is in custody for about 320 days. It is submitted he is in no way connected with trafficking of women. Learned Advocate for the State opposes the prayer for bail.

We have considered the materials on record. Conjoint reading of the statement of the victim girl recorded under Section 161/164 of the Code of Criminal Procedure discloses role of the petitioner in trafficking her across the international border. It further appears that the petitioner had called the victim girl when she had been apprehended by the raiding party prima facie disclosing his involvement in the crime.

In view of the materials on record, gravity of the offence and as trial is in progress, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.
